Terms of Service

Welcome to PopGamma, an AI-powered educational tutoring application created by Nxten Technologies Private Limited ("PopGamma", "we", "us", or "our").

By accessing or using the PopGamma mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms apply to all users of the App, including parents, guardians, and learners.

• PopGamma is designed for learners aged 6 and older, used under the supervision of a parent or legal guardian
• A parent or legal guardian must create and manage the account on behalf of the learner
• By creating an account, you represent that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal authority to accept these Terms on behalf of your child
• You are responsible for supervising your child's use of the App and for any consequences arising from such use

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

PopGamma is available on a free plan and on optional paid monthly plans (Starter, Super and Ultra). Each plan grants an allowance of AI-powered features: Homework Help sessions, mock exam simulations, Quick Practice, voice tutoring with Prof. Albert, and Study Plan chapters.

The allowance that applies to your account, and how much of it remains, is always shown in the App. We publish the current figures there rather than in these Terms so that they remain accurate. The rules below describe how those allowances work.

How allowances work:

• Monthly allowances reset once per month. On a paid plan, the reset is aligned with your subscription's renewal date
• Unused allowance does not carry over to the next period
• Voice tutoring on the free and Starter plans is a one-time allowance of 5 minutes, not a monthly one — it does not reset. If you move from the free plan to Starter, your remaining balance carries over; Starter includes the same one-time allowance rather than adding new minutes to it. Voice minutes reset monthly on the Super and Ultra plans only
• Individual voice sessions are limited to 6 minutes each
• Allowances are per parent account and shared across all learner profiles under that account
• Study Plans and chapters can be created without limit on every plan, including the free plan. On the free plan you may start one new chapter per day; re-opening a chapter you have already started on the same day is always free. The daily counter resets at midnight India Standard Time (UTC+5:30), wherever you are located
• Fair use. Features presented as "unlimited" are subject to reasonable technical ceilings whose sole purpose is to prevent abuse and automated use. These ceilings are set well above normal individual use and are not intended to affect ordinary use of the App. We may enforce them, without prior notice, against accounts showing abusive, shared or automated activity
• We may modify plans, allowances and prices at any time, with reasonable notice through the App or by email. A change to the price or allowance of a paid plan will not take effect before the end of your current billing period

a) Monthly subscription plans

PopGamma offers three optional auto-renewing monthly subscriptions: Starter, Super and Ultra. Each has a one-month term. Only one subscription can be active at a time, and there is no free trial or introductory period. In India the current prices are ₹99, ₹249 and ₹799 per month respectively. The price applicable to you, in your local currency, is always displayed in the App before you confirm the purchase. Where the App shows a promotional price next to a struck-through reference price, the amount actually charged is the one confirmed by the App Store or Google Play at checkout.

b) Exam Boost (one-time)

Exam Boost is a one-time, non-renewing purchase that adds 5 mock exam simulations on top of your current plan's allowance. It is valid for 30 days from the date of purchase, whether used or not, and does not renew. Exam Boost is not a subscription and does not change your plan. Your plan's own allowance is always consumed before your Exam Boost quota.

c) Courses

Certain courses (such as PopCamp Public Speaking) are sold as separate one-time purchases granting access to that course. They are not subscriptions and do not renew.

d) Auto-renewal and billing

• A subscription renews automatically for the same term and price unless it is cancelled at least 24 hours before the end of the current period
• Your store account is charged for the renewal within the 24 hours preceding the end of the current period
• All purchases and renewals are billed by Apple (App Store) or Google (Google Play). PopGamma never receives or stores your payment card details
• Prices are shown in your local currency and may vary by region and over time
• You can view, manage or cancel your subscription at any time in your App Store or Google Play account settings. The App provides a shortcut to that screen

e) Upgrades and downgrades

• Upgrades take effect immediately. The store applies its own proration to the amount charged. Your allowances become those of the new plan at once, and the usage already recorded in the current period is carried over and counted against them — an upgrade always increases what is available to you, never decreases it
• Downgrades take effect at the end of your current billing period. You keep the benefits of your higher plan, and the allowance already granted, until that date. Your new allowance and its reset schedule apply from the next renewal onwards

f) Failed payments and grace period

If a renewal payment fails, your paid access is temporarily maintained while the store retries the payment — a grace period of up to 7 days after the end of your period. If payment has still not succeeded after that, your account reverts to the free plan.

g) Purchase verification

Purchases are confirmed with Apple or Google and activated automatically, usually within a few seconds. If a purchase needs a parent's approval (Apple "Ask to Buy") or additional bank authentication, it activates automatically once approved. You will never be charged twice for the same purchase. If a purchase has not appeared after a few minutes, contact contact@popgamma.com with your transaction reference.

h) Restoring access

Your subscription is attached to your PopGamma account. If you reinstall the App or change device, sign in with the same account to recover it. You can also restore purchases from your Apple ID subscriptions (iOS), or contact contact@popgamma.com (Android).

• All purchases are billed by Apple (App Store) or Google (Google Play). PopGamma never receives your payment details and does not process payments. A refund request can always be submitted directly to the relevant store, which decides it under its own policy
• You can also write to contact@popgamma.com within 14 days of the charge. We review each request individually. For a purchase made through Google Play, where we consider a refund justified we can issue it ourselves. For a purchase made through the App Store, only Apple can issue a refund: we submit and support the request with Apple on your behalf, and the final decision rests with Apple
• Exam Boost is a consumable credited immediately on purchase. Once its exam simulations have been used it is not refundable, except where required by law
• No prorated refund is given for a partially used subscription period, for unused monthly allowance, or for an expired Exam Boost quota, except where required by law
• If a technical problem prevents you from using something you have paid for, contact contact@popgamma.com — we will resolve it or support your refund request with the store

• You can cancel a subscription at any time from your App Store or Google Play subscription settings. PopGamma cannot cancel a store subscription on your behalf
• Cancelling stops future renewals. You keep your paid benefits and your remaining allowance until the end of the period you have already paid for; the App shows that date
• At the end of that period your account returns to the free plan: monthly allowances stop refilling and free-plan limits apply again
• Nothing is deleted when you downgrade or when a subscription ends. Your Study Plans, chapters, progress and history are kept. Only your allowances change — for example, you may again start one new Study Plan chapter per day instead of an unlimited number
• An Exam Boost quota remains usable until its 30-day expiry, whatever your plan
• Upon account deletion, any remaining subscription period, Exam Boost quota and course access are forfeited without refund. Deleting your PopGamma account does not cancel your store subscription — you must also cancel it in your App Store or Google Play settings to stop being billed

PopGamma uses artificial intelligence to generate educational content, including but not limited to: explanations, solved problems, quizzes, study cards, exam questions, and exam evaluations.

You acknowledge and agree that:

• AI-generated content may contain errors, inaccuracies, or incomplete information
• Content is provided for educational purposes only and does not constitute professional academic, medical, psychological, or any other form of professional advice
• Parents and guardians must supervise their child's interaction with AI-generated content
• PopGamma does not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular educational standard or examination
• You should not rely solely on PopGamma for exam preparation or academic achievement

• You retain ownership of any content you submit through the App (questions, images, voice recordings)
• By submitting content, you grant PopGamma a non-exclusive, worldwide, royalty-free license to use, process, and store that content for the purpose of providing and improving the educational service
• You must not submit content that is unlawful, harmful, threatening, abusive, or otherwise objectionable
• We reserve the right to remove content that violates these Terms

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Distribute malware, viruses, or any harmful code through the App
• Interfere with or disrupt the integrity or performance of the App
• Reverse-engineer, decompile, or attempt to extract the source code of the App
• Use the App to generate content for commercial resale or redistribution
• Create multiple accounts to circumvent usage limits or abuse the free tier
• Share account credentials with third parties

• All materials in the App are the property of Nxten Technologies Private Limited or its licensors
• You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial educational purposes
• You may not copy, modify, distribute, sell, or lease any part of the App or its content without our prior written consent

To the maximum extent permitted by applicable law:

• PopGamma and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
• PopGamma shall not be liable for any errors, inaccuracies, or omissions in AI-generated content, or for any actions taken based on such content
• PopGamma shall not be liable for any loss resulting from expired or unused allowances, Exam Boost quotas, or subscription periods
• Our total liability for any claim shall not exceed the amount you paid to us in the twelve (12) months preceding the claim
• Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law

• These Terms are governed by and construed in accordance with the laws of India
• Any disputes shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India
• Before initiating formal proceedings, you agree to attempt to resolve any dispute informally by contacting us at contact@popgamma.com

In accordance with the Information Technology Act, 2000:

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date and notify you via email or in-app notification. Your continued use of PopGamma after changes are posted constitutes your acceptance of the updated Terms.
