Terms of Service

Welcome to PopGamma, an AI-powered educational tutoring application created by Nxten Technologies Private Limited ("PopGamma", "we", "us", or "our").

By accessing or using the PopGamma mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms apply to all users of the App, including parents, guardians, and learners.

• PopGamma is designed for learners aged 6 and older, used under the supervision of a parent or legal guardian
• A parent or legal guardian must create and manage the account on behalf of the learner
• By creating an account, you represent that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal authority to accept these Terms on behalf of your child
• You are responsible for supervising your child's use of the App and for any consequences arising from such use

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

PopGamma offers a free tier with the following monthly usage limits:

Important terms:

• Usage limits reset automatically at the beginning of each monthly billing cycle
• Unused quota from one month does not carry over to the next month
• Usage limits are per parent account and shared across all learner profiles under that account
• We reserve the right to modify usage limits at any time. We will provide reasonable notice of any changes through the App or by email

PopGamma offers optional Exam Packs that provide additional exam quotas beyond the free tier:

b) Purchase Terms

• All purchases are non-renewing: packs expire after one (1) calendar month from purchase
• Purchases are processed through Google Play (Android) or Apple App Store (iOS)
• Prices are displayed in your local currency and may vary by region
• Free tier quota is consumed first before pack quota
• Unused pack quota does not carry over or transfer after expiration
• We reserve the right to modify pack offerings, quotas, and pricing. Changes will not affect already-purchased packs

c) Purchase Verification

Purchases are verified automatically upon receipt of confirmation from Google Play or Apple. If your purchase does not appear within a few minutes, please contact contact@popgamma.com.

• All in-app purchases are processed by Google Play or Apple App Store. Refund requests must be submitted through the respective store.
• PopGamma does not process refunds directly
• If you experience a technical issue preventing you from using a purchased Exam Pack, please contact us at contact@popgamma.com and we will work to resolve the issue or assist with your refund request through the store

• Exam Packs expire automatically one (1) calendar month from the date of purchase
• No prorated refunds are provided for unused quota at the time of expiration
• Since Exam Packs are non-renewing, there is no recurring subscription to cancel
• Upon account deletion, all active Exam Packs are forfeited with no refund
• You can view your active packs and remaining quotas at any time within the App

PopGamma uses artificial intelligence to generate educational content, including but not limited to: explanations, solved problems, quizzes, study cards, exam questions, and exam evaluations.

You acknowledge and agree that:

• AI-generated content may contain errors, inaccuracies, or incomplete information
• Content is provided for educational purposes only and does not constitute professional academic, medical, psychological, or any other form of professional advice
• Parents and guardians must supervise their child's interaction with AI-generated content
• PopGamma does not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular educational standard or examination
• You should not rely solely on PopGamma for exam preparation or academic achievement

• You retain ownership of any content you submit through the App (questions, images, voice recordings)
• By submitting content, you grant PopGamma a non-exclusive, worldwide, royalty-free license to use, process, and store that content for the purpose of providing and improving the educational service
• You must not submit content that is unlawful, harmful, threatening, abusive, or otherwise objectionable
• We reserve the right to remove content that violates these Terms

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Distribute malware, viruses, or any harmful code through the App
• Interfere with or disrupt the integrity or performance of the App
• Reverse-engineer, decompile, or attempt to extract the source code of the App
• Use the App to generate content for commercial resale or redistribution
• Create multiple accounts to circumvent usage limits or abuse the free tier
• Share account credentials with third parties

• All materials in the App are the property of Nxten Technologies Private Limited or its licensors
• You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial educational purposes
• You may not copy, modify, distribute, sell, or lease any part of the App or its content without our prior written consent

To the maximum extent permitted by applicable law:

• PopGamma and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
• PopGamma shall not be liable for any errors, inaccuracies, or omissions in AI-generated content, or for any actions taken based on such content
• PopGamma shall not be liable for any loss resulting from expired or unused Exam Pack quotas
• Our total liability for any claim shall not exceed the amount you paid to us in the twelve (12) months preceding the claim
• Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law

Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and protect your data.

• These Terms are governed by and construed in accordance with the laws of India
• Any disputes shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India
• Before initiating formal proceedings, you agree to attempt to resolve any dispute informally by contacting us at contact@popgamma.com

In accordance with the Information Technology Act, 2000:

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date and notify you via email or in-app notification. Your continued use of PopGamma after changes are posted constitutes your acceptance of the updated Terms.
